Proyecto de Resoluci\u00f3n: Solicitar\u00a0 pedido de informe\u00a0 al Sr.\u00a0 Presidente del Honorable Concejo\u00a0 Deliberante sobre caso\u00a0 de extorsi\u00f3n a\u00a0 un miembro del Cuerpo Legislativo.<\/p>\n<p>Que se ha hecho p\u00fablica la noticia de que un agente municipal habr\u00eda extorsionado a un miembro de este Concejo Deliberante.<\/p>\n<p>y;<\/p>\n<p>CONSIDERANDO: Que el delito de extorsi\u00f3n requiere que la v\u00edctima movida por la \u00a0 violencia o intimidaci\u00f3n ejercida efect\u00fae un desplazamiento patrimonial en beneficio \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 del autor.<\/p>\n<p>Que seg\u00fan reiterada jurisprudencia, la intimidaci\u00f3n consiste en el anuncio de un mal\u00a0\u00a0 inmediato, grave personal y posible, que despierte o inspire en la v\u00edctima \u00a0\u00a0\u00a0\u00a0\u00a0 un sentimiento de miedo, angustia o desasosiego, una inquietud an\u00edmica, apremiante \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 o aprehensi\u00f3n racional o recelo m\u00e1s o menos justificado, ante la contingencia de \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 un da\u00f1o real o imaginario.<\/p>\n<p>Que \u00a0el Reglamento\u00a0 Interno del Honorable Concejo Deliberante en su Art\u00edculo 46\u00b0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 dice: \u201cCualquier acto en contra de alg\u00fan miembro\u00a0 es como\u00a0 si fuese\u00a0 sobre el Concejo\u00a0 mismo\u201d.<\/p>\n<p>Que es necesario\u00a0 aclarar\u00a0 la situaci\u00f3n\u00a0 para salvaguardar\u00a0 el honor de este Cuerpo, \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 sus miembros y personal.<\/p>\n<p>EL HONORABLE CONCEJO DELIBERANTE DE LA MUNICIPALIDAD DE MALARG\u00dcE EN USO DE LAS FACULTADES QUE LE SON PROPIAS<\/p>\n<p>RESUELVE<\/p>\n<p>ART\u00cdCULO 1\u00b0: Solicitar al\u00a0 Presidente del Honorable Concejo Deliberante informe sobre:<\/p>\n<p>*Si tiene conocimiento de la denuncia y en qu\u00e9 consiste,<\/p>\n<p>*Qui\u00e9n son los implicados<\/p>\n<p>*Estado de la instrucci\u00f3n<\/p>\n<p>ART\u00cdCULO 2\u00b0:Comun\u00edquese, reg\u00edstrese, agr\u00e9guese copia de la presente en las actuaciones \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 correspondientes y arch\u00edvese.<\/p>\n<p>DADA EN LA SALA DE SESIONES DR.
