<\/a><\/p>\nCONSIDERANDO: Que por mandato de los Arts. 116\u00b0 y 117\u00b0 de la Ley N\u00b0 1.079, el Departamento Ejecutivo deber\u00e1 constituir el Jury de Reclamos con vecinos que re\u00fanan las condiciones all\u00ed establecidas.<\/p>\n
Que sin dudas, las distintas gestiones municipales han omitido y olvidado otorgarle cumplimiento a tal\u00a0 normativa.<\/p>\n
Que ante los recientes errores de aforos producidos por malas interpretaciones o montos por dem\u00e1s onerosos y\/o confiscatorios, en concepto de tasas y servicios respecto de los periodos 2.019\/2.020 y 2.021, tal como fuera reconocido por ese Departamento Ejecutivo en el Art. 51\u00b0 de la Ordenanza N\u00b0 2.113\/21, resulta necesario crear dicho espacio de representaci\u00f3n ciudadana, constituyendo el Jury de Reclamos, para considerar, ante el reclamo de un contribuyente, si corresponde o no el monto de la cuota o rubro de los servicios, derechos y contribuciones municipales.<\/p>\n
Que asimismo y a los fines de asignarle funcionalidad al JURY de Reclamos, \u00e9ste Honorable Cuerpo deber\u00e1 constituir, una vez creado el Jury de Reclamos, la Comisi\u00f3n Especial que prev\u00e9 el Art. 117\u00b0 de la Ley N\u00b0 1.079.<\/p>\n
Que no habiendo sido presentado el Proyecto de Presupuesto de Gastos y C\u00e1lculos de Recursos correspondiente al Ejercicio 2.022 y Proyecto de Ordenanza Tarifaria 2.022, en legal t\u00e9rmino y forma, de acuerdo a lo reglamentado por Ley N\u00b0 1.079, y habiendo sido ingresado ambas piezas legales a este Honorable Cuerpo en la sesi\u00f3n del 31 de marzo de 2.022, es que dichos motivos justifican la presente petici\u00f3n.<\/p>\n
Que es preciso obrar en consecuencia.<\/p>\n
EL HONORABLE CONCEJO DELIBERANTE DE LA MUNICIPALIDAD DE MALARGUE EN USO DE LAS FACULTADES QUE LE SON PROPIAS<\/p>\n
RESUELVE<\/p>\n
ART\u00cdCULO 1\u00ba: Solicitar al Departamento Ejecutivo Municipal d\u00e9 cumplimiento a los Art\u00edculos 116\u00b0 y 117\u00b0 de la Ley N\u00b0 1.079 Org\u00e1nica de Municipalidades, debiendo constituir cada a\u00f1o el JURY de Reclamos con las condiciones, requisitos y funciones all\u00ed establecidas.<\/p>\n
ART\u00cdCULO 2\u00ba: Elevar copia de la presente pieza legal al Sr. Maximiliano Salvadores suscribiente de las notas de referencia.<\/p>\n
