Proyecto de Resoluci\u00f3n: Invitar a los Honorables Concejos Deliberantes de San Rafael y General Alvear a una reuni\u00f3n para tratar el Aprovechamiento Multiprop\u00f3sito del R\u00edo Grande, en nuestro Departamento.<\/p>\n<p>El discurso del Gobernador Rodolfo Su\u00e1rez durante la apertura de Sesiones Legislativas del a\u00f1o 2022, respecto a desistir de la realizaci\u00f3n de la mega obra Portezuelo del Viento si el Se\u00f1or presidente solicitaba un nuevo estudio de impacto ambiental y, a su vez, declaraciones del Presidente en un acto en la Provincia de La Pampa, adelantando que iba a solicitar un estudio de impacto ambiental sobre toda la cuenca.<\/p>\n<p>Y;<\/p>\n<p>CONSIDERANDO: Que la presa es la mayor obra de ingenier\u00eda civil de la historia de Mendoza y su construcci\u00f3n ser\u00eda la culminaci\u00f3n de un proyecto que naci\u00f3 hace m\u00e1s de medio siglo.<\/p>\n<p>Que se estima que Portezuelo tendr\u00e1 una potencia instalada de 210 MW, que generar\u00e1 a lo largo de un a\u00f1o una energ\u00eda media de 889 GWh, capaz de abastecer a 130000 usuarios, cuatro veces m\u00e1s de lo que genera el Dique Potrerillos en la actualidad.<\/p>\n<p>Que la obra est\u00e1 planteada para cumplir m\u00faltiples prop\u00f3sitos, permitiendo proteger la cuenca media y superior del R\u00edo Colorado de crecidas intempestivas, as\u00ed como aumentar la garant\u00eda de riego para agricultura y ganader\u00eda en el sur provincial.<\/p>\n<p>Que los fondos para el aprovechamiento multiprop\u00f3sito Portezuelo del Viento fueron asignados por una Ley del Congreso de la Naci\u00f3n en el a\u00f1o 2019.<\/p>\n<p>Que mientras se encuentre vigente el estudio de impacto ambiental como condicionante del laudo presidencial, significa que la obra es de posible realizaci\u00f3n, por lo que la licitaci\u00f3n sigue vigente y los fondos no podr\u00edan tener otro destino, en principio.<\/p>\n<p>Que el resultado del juicio entre la Provincia de Mendoza y la Naci\u00f3n Argentina por los perjuicios de la promoci\u00f3n industrial es la realizaci\u00f3n de esta obra interprovincial para el aprovechamiento integral del R\u00edo Grande.<\/p>\n<p>Que hubo un pliego y un oferente que reuni\u00f3 las condiciones solicitadas, resultando ganador de la licitaci\u00f3n, por lo que desistir de la obra podr\u00eda generar conflictos judiciales.<\/p>\n<p>Que existen argumentos de legalidad para defender la obra, ya que el destino de los fondos tiene acuerdo del Congreso de la Naci\u00f3n.<\/p>\n<p>Que existen argumentos de convencionalidad, porque preexisten hist\u00f3ricos acuerdos entre Provincia y Naci\u00f3n para la realizaci\u00f3n de la obra.<\/p>\n<p>Que existen argumentos de legitimidad, ya que est\u00e1 sobradamente demostrado que los mayores perjuicios del R\u00e9gimen de Promoci\u00f3n Industrial de las provincias vecinas fueron en la zona sur de la Provincia de Mendoza y el juicio se inici\u00f3 por iniciativa sure\u00f1a.<\/p>\n<p>EL HONORABLE CONCEJO DELIBERANTE DE LA MUNCIPALIDAD DE MALARGUE EN SUS FACULTADES QUE LES SON PROPIAS<\/p>\n<p>RESUELVE<\/p>\n<p>ART\u00cdCULO 1\u00ba: Invitar a los Honorables Concejos Deliberantes de los Departamentos de Gral. Alvear y San Rafael a participar de una reuni\u00f3n ampliada de la Comisi\u00f3n de Hidrocarburos, Energ\u00eda Y Miner\u00eda del Honorable Concejo Deliberante del Departamento de Malarg\u00fce por el Proyecto: Aprovechamiento Multiprop\u00f3sito del R\u00edo Grande \u2013 Mega Obra Portezuelo del Viento, para trabajar sobre acuerdos y entendimientos posibles.<\/p>\n<p>ART\u00cdCULO 2\u00b0: Determinar por Presidencia del Honorable Concejo Deliberante, fecha y hora a convenir a los fines de llevarse a cabo la reuni\u00f3n del Art\u00edculo 1\u00b0.<\/p>\n<p>ART\u00cdCULO 3\u00ba: Comun\u00edquese, reg\u00edstrese, agr\u00e9guese copia de la presente en las actuaciones correspondientes y arch\u00edvese.<\/p>\n<p>DADA EN LA SALA DE SESIONES DR.
