VISTO: El contenido del Expediente N\u00b0 5.304-HC 056-2.023 Interbloque Reconstruyendo Malarg\u00fce, Frente de Todos, Frente Cambia Mendoza, U.C.R-Independiente, Cuidemos Malarg\u00fce. Proyecto de Resoluci\u00f3n: Solicitar al I.P.V, tenga a bien reconsiderar el mecanismo de cr\u00e9dito ajustado U.V.A, a las viviendas del Barrio El Trapal II. <\/p>\n\n\n\n

La preocupaci\u00f3n puesta de manifiesto por los vecinos del Barrio Trapal II de nuestro Departamento, respecto al incremento en las cuotas de sus viviendas.<\/p>\n\n\n\n

y;<\/p>\n\n\n\n

CONSIDERANDO: Que es imprescindible plantear de manera preliminar que el endeudamiento de la persona humana y\/o de su grupo familiar est\u00e1 condicionado a la protecci\u00f3n de su bienestar, sus derechos e intereses econ\u00f3micos.<\/p>\n\n\n\n

Que el endeudamiento de muchas familias argentinas a trav\u00e9s de cr\u00e9ditos ajustados por Unidades de Valor Adquisitivo (UVA) o Coeficiente de Estabilizaci\u00f3n de Referencia (CER), representa una grave problem\u00e1tica que solo fue objeto de respuestas parciales destinadas a mitigar y\/o contener su impacto en algunos grupos sociales o, en otros casos, luego de presentaciones judiciales a t\u00edtulo particular.<\/p>\n\n\n\n

Que este mecanismo de ajuste de deuda fue adoptado por el Estado Nacional en sus pol\u00edticas p\u00fablicas destinadas a garantizar el derecho a la vivienda, implicando el quiebre del car\u00e1cter \u201csoportable\u201d del gasto de vivienda (Comit\u00e9 DESC \u201cObservaci\u00f3n General N\u00b04\u201d p\u00e1r. 8.c).<\/p>\n\n\n\n

Que muchas familias se han visto expuestas a un sobreendeudamiento, situaci\u00f3n que desnaturaliza el propio objeto de este tipo de programas estatales de cr\u00e9dito.<\/p>\n\n\n\n

Que en este sentido, es innegable reconocer el fracaso del UVA como mecanismo de endeudamiento.<\/p>\n\n\n\n

Que existen proyectos de ley en el \u00e1mbito nacional que intentan mitigar los efectos da\u00f1osos de este tipo de cr\u00e9ditos a la econom\u00eda familiar de los argentinos, pero no hay una toma de posicionamiento pol\u00edtico unificada que traiga una soluci\u00f3n permanente.<\/p>\n\n\n\n

Que en este contexto, el cr\u00e9dito UVA implica actualmente una carga extraordinaria para los deudores del Barrio El Trapal, quienes llegan a percibir cuotas que representan el 70 % de sus ingresos, tal como se expone en el anexo de la presente pieza legal.<\/p>\n\n\n\n

Que en consecuencia, se solicita al Instituto Provincial de la Vivienda que el pago de la deuda de la vivienda como obligaci\u00f3n asumida sea posible en condiciones de dignidad, bajo el esquema de Unidad de Referencia Salarial (URS).<\/p>\n\n\n\n

Que existen antecedentes de reconversi\u00f3n de la deuda de mecanismo UVA a URS por los motivos antes expresados.<\/p>\n\n\n\n

Que como Estado, tenemos el deber de animar la conducta y responsabilidad crediticia de los ciudadanos, brindando herramientas para que se haga efectiva, factible y no se produzcan moras que a largo plazo generen perjuicios mayores en los morosos.<\/p>\n\n\n\n

EL HONORABLE CONCEJO DELIBERANTE DE LA MUNICIPALIDAD DE MALARG\u00dcE EN USO DE LAS FACULTADES QUE LE SON PROPIAS<\/p>\n\n\n\n

RESUELVE<\/p>\n\n\n\n

ART\u00cdCULO 1\u00ba: Solicitar al Instituto Provincial de la Vivienda tenga a bien reconsiderar el mecanismo de cr\u00e9dito ajustado por UVA de las viviendas del Barrio El Trapal II del Departamento de Malarg\u00fce, utilizando el esquema que mejor se adecue al contexto local.<\/p>\n\n\n\n

ART\u00cdCULO 2\u00ba: Elevar copia de la presente pieza legal y sus anexos a las Comisiones de Derechos y Garant\u00edas de las Honorables C\u00e1maras de Diputados y Senadores respectivamente, a los efectos de intervenir seg\u00fan mejor criterio de los Se\u00f1ores Legisladores.<\/p>\n\n\n\n

ART\u00cdCULO 3\u00ba: Elevar copia de la presente pieza legal a la Comisi\u00f3n de la Uni\u00f3n Vecinal o representantes del Barrio el Trapal II.<\/p>\n\n\n\n
