VISTO: El contenido del Expediente N\u00b0 4.007\/2.022-0 Direcci\u00f3n de Asesor\u00eda Letrada. Instruir Pol\u00edticas de Fomento al Desarrollo Productivo sobre bases uniformes que respeten la realidad imperante al d\u00eda de la fecha- Res. Unidad T\u00e9cnica de Gesti\u00f3n Urbana Rural Ambiental Malarg\u00fce.<\/p>\n\n\n\n

CONSIDERANDO: Que se presenta al Honorable Concejo Deliberante de Malarg\u00fce, formal nota, a efectos de remitir Expte. Municipal N\u00b0 4.007\/2.022 Ref. “Direcci\u00f3n de Asesor\u00eda Letrada – Proyecto de Resoluci\u00f3n Unidad T\u00e9cnica de Gesti\u00f3n Urbana Rural Ambiental, acompa\u00f1ando Resoluci\u00f3n N\u00b0 01\/2.022, elaborada por la Unidad T\u00e9cnica de Gesti\u00f3n Urbana Rural Ambiental Malarg\u00fce, teniendo presente la situaci\u00f3n evidente en la zona denominada como calle “Los Abedules”, determinando en su parte resolutiva, Art. 1\u00b0, como Uso de Suelo Mixto la zona identificada como calle Los Abedules, estableciendo los puntos y sistema de referencia, para en su Art\u00edculo 2\u00b0: Autorizar actividades agr\u00edcolas, residenciales, tur\u00edsticas, recreativas, comerciales en la zona mencionada ut-supra.<\/p>\n\n\n\n

Que asimismo se acompa\u00f1a Ordenanza Municipal N\u00b0 1.893 y Decreto N\u00b01.007\/2.022 de designaci\u00f3n de representantes de la Municipalidad de Malarg\u00fce ante la Unidad T\u00e9cnica de Gesti\u00f3n Urbana Rural Ambiental Malarg\u00fce.<\/p>\n\n\n\n

Que una vez ingresada la iniciativa al Recinto de este Cuerpo y por disposiciones del Reglamento Interno del Honorable Concejo Deliberante, pasa sin m\u00e1s tr\u00e1mite y por Resoluci\u00f3n N\u00b0 452\/2.022 a Comisi\u00f3n de Hacienda, Presupuesto, Legislaci\u00f3n y Asuntos Constitucionales.<\/p>\n\n\n\n

Que luego del estudio, trabajo en la Comisi\u00f3n y de haber tomado conocimiento y acceder a distintos informes, tales como Solicitud de Factibilidad<\/em> por parte del Sr. Schajnovetz Marcelo Alberto e Informe de Factibilidad<\/em> de la Direcci\u00f3n de Tierra, Catastro y Ordenamiento Territorial, de fecha 07 de Diciembre de 2.022, se advierte que el Departamento Ejecutivo Municipal ha resuelto en relaci\u00f3n a calle Los Abedules s\/n, en la propiedad del Sr. Schajnovetz y ante la petici\u00f3n de “Construcci\u00f3n De Vivienda” lo siguiente: “Por lo tanto el pedido Es Factible<\/em> su emplazamiento con restricciones”. El mismo deber\u00e1: Cumplir con la normativa vigente de Obras Privadas y Direcci\u00f3n de Rentas Municipal”.<\/p>\n\n\n\n

Que en virtud de lo expuesto, y recayendo por ende en abstracto el tratamiento del presente expediente, en virtud de las factibilidades otorgadas por parte del Departamento Ejecutivo Municipal, habiendo generado un desgaste legislativo innecesario, es que se resuelve devolver las presentes actuaciones.<\/p>\n\n\n\n

EL HONORABLE CONCEJO DELIBERANTE DE LA MUNICIPALIDAD DE MALARG\u00dcE EN USO DE LAS FACULTADES QUE LE SON PROPIAS<\/p>\n\n\n\n

RESUELVE<\/p>\n\n\n\n

ART\u00cdCULO 1\u00ba: Devolver las actuaciones del Expediente N\u00b0 4.007\/2.022-0 al Departamento Ejecutivo Municipal, en virtud de recaer en abstracto el tratamiento ante las factibilidades otorgadas por la Direcci\u00f3n de Catastro respecto a las peticiones de “Construcci\u00f3n de Vivienda” sobre calle Los Abedules s\/n en propiedad del Sr. Marcelo Alberto Schajnovetz, debiendo por ende continuar ante la Municipalidad de Malarg\u00fce los tr\u00e1mites legales y administrativos correspondientes<\/p>\n\n\n\n

ART\u00cdCULO 2\u00ba: Comun\u00edquese, reg\u00edstrese, agr\u00e9guese copia de la presente en las actuaciones correspondientes y arch\u00edvese.<\/p>\n\n\n\n
