Proyecto de Resoluci\u00f3n: Solicitar a la Legislatura de la Provincia de Mendoza, la urgente modificaci\u00f3n de la Ley N\u00ba 9.202. \u201cRegulaci\u00f3n Dominial o Readjudicaci\u00f3n a los actuales poseedores de los terrenos de Colonia\u00a0 Pehuenche I y II<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; y;<\/p>\n\n\n\n<p>CONSIDERANDO: Que la <a href=\"https:\/\/hcd.malargue.gov.ar\/?p=34659\">Resoluci\u00f3n N\u00ba 301\/2.023<\/a> tiene como objetivo solicitar a la \u00a0 Legislatura de la Provincia de Mendoza, la urgente modificaci\u00f3n de la Ley N\u00ba 9.202 de regularizaci\u00f3n dominial o re adjudicaci\u00f3n a los actuales poseedores de los terrenos de Colonia Pehuenche I y II.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que la finalidad de esta Ley es la regulaci\u00f3n para inscripci\u00f3n de dominio, beneficiando a los pobladores&nbsp; y en consecuencia un desarrollo organizado del Departamento.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que hay un gran porcentaje de vecinos poseedores de terrenos en la zona de Colonia Pehuenche I y II que no pueden acceder a la regularizaci\u00f3n dominial por poseer menos de 2.000 metros cuadrados<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que la finalidad de la vigente Ley, no tiene alcance para la mayor\u00eda de los ciudadanos poseedores en las Colonia Pehuenche I y II.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que es de gran importancia la regulaci\u00f3n dominial para lograr autorizaci\u00f3n correspondiente de conexi\u00f3n a los servicios b\u00e1sicos.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que es menester que la norma se adecue a la realidad de esa zona del Departamento de Malarg\u00fce.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que el Art\u00edculo 14\u00ba de la Ley N\u00ba 9.202 dice:&nbsp; \u201cEl Poder Ejecutivo deber\u00e1 reglamentar la presente Ley, dentro de los sesenta (60) d\u00edas de su promulgaci\u00f3n\u201d.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Que el Art\u00edculo 10\u00ba de la Ley N\u00ba 9.202 inc. a dice: \u201cLas parcelas deber\u00e1n asegurar la superficie m\u00ednima y requisitos establecidos en la zonificaci\u00f3n rural municipal y en el Plan Municipal de Ordenamiento Territorial de Malarg\u00fce una vez vigente. Hasta que se concrete la regularizaci\u00f3n objeto de la presente, la superficie de parcela m\u00ednima para poder entrar dentro de los beneficios de la presente ley ser\u00e1 de DOS MIL METROS CUADRADOS (2000m2)\u201d.<\/p>\n\n\n\n<p>EL HONORABLE CONCEJO DELIBERANTE DE LA MUNICIPALIDAD DE MALARG\u00dcE EN USO DE LAS FACULTADES QUE LE SON PROPIAS.<\/p>\n\n\n\n<p>RESUELVE<\/p>\n\n\n\n<p>ART\u00cdCULO 1\u00ba: Solicitar a los Legisladores de la Provincia de Mendoza, modificaci\u00f3n Art\u00edculo 10 inc. A y B de la Ley Provincial N\u00ba\u00a0 9.202, para que poseedores de terrenos con menos de 2.000 metros cuadrados puedan acceder a su regularizaci\u00f3n dominial y puedan destinar estos a vivienda familiar.<\/p>\n\n\n\n<p>ART\u00cdCULO 2\u00ba: Solicitar al Poder Ejecutivo Provincial la derogaci\u00f3n o modificaci\u00f3n del Art\u00edculo 14\u00ba\u00a0 del Decreto Reglamentario 1.964\/2.020 de la Ley Provincial N\u00ba\u00a0 9.202.<\/p>\n\n\n\n<p>ART\u00cdCULO 3\u00ba: Enviar copia a digital\u00a0 de la presente pieza legal al Director de Gesti\u00f3n de \u00a0Inmuebles Fiscales Dn. Ramiro Canet, a las Senadoras Provinciales por\u00a0 el\u00a0 Departamento de Malarg\u00fce, Alejandra Barro; Jesica Laferte\u00a0 y Diputada Provincial\u00a0 por el Departamento de Malarg\u00fce Lic.
